Terms of Service

1. Eligibility and Scope

The Service is available to users in India, Singapore, and other countries where the Service is offered. You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service.

2. Account Registration and Authentication

• To register, you must provide a valid email address.
• An authentication link will be sent to your email. Clicking the link completes your registration.
• No password is required to create or access your account.
• You are solely responsible for managing and protecting access to your email account, user ID, and authentication links.
• We are not responsible for any loss or damage resulting from unauthorized access caused by your failure to manage these credentials appropriately.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

3. Blacklisted Email Addresses

We reserve the right, at our sole discretion, to restrict, suspend, or deny registration or login for specific email addresses, including those placed on our internal blacklist, without prior notice.

4. Service Availability and Changes

• Certain features may be offered free of charge at the time of service launch.
• Paid features and subscription plans may be introduced in the future.
• We reserve the right to modify, add, suspend, or discontinue any part of the Service at any time.

5. Credit Purchases

• The Service offers one-time credit package purchases. Credits are used to access paid features such as AI-powered idea generation.
• Credit packages are available in fixed quantities (e.g., 30, 100, or 500 credits) and are purchased as a single, non-recurring transaction.
• You are responsible for all applicable taxes, including GST or VAT, associated with your purchase.
• Purchased credits do not expire and are non-transferable.
• All credit purchases are final. No refunds will be issued for purchased credits, as they constitute digital goods delivered immediately upon purchase, unless required by applicable law.

6. Account Deletion

• You may delete your account at any time through Account Settings.
• Upon account deletion:
  • You will immediately lose access to the Service.
  • Any remaining unused credits are forfeited and are not refundable.
• Once deleted, an account cannot be restored, even if you attempt to re-register using the same email address.

7. Prohibited Conduct

You agree not to engage in any of the following activities:

• Violating any applicable laws or regulations
• Infringing upon intellectual property rights
• Attempting unauthorized access to the Service or its systems
• Disrupting or interfering with the Service or its security
• Misusing the Service for fraudulent, harmful, or abusive purposes
• Using the Service in a manner that could damage, disable, or impair it
• Being a member of or affiliated with an organized crime group or other anti-social forces
• Using the Service to generate content that promotes hate speech, violence, or illegal activities
• Engaging in money laundering or terrorist financing activities

8. Intellectual Property

All content, features, algorithms, and functionality of the Service (excluding User Input and Output) are owned by or licensed to Prakasya and are protected by applicable intellectual property laws.

Ownership of Output: As between you and Prakasya, you own all rights, title, and interest in and to the queries you input into the Service ("Input") and the content generated by the Service based on your Input ("Output").

License to Prakasya: You grant us a non-exclusive, worldwide, royalty-free license to use your Input and Output solely for the purpose of operating, providing, and improving the Service.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis.

We make no warranties, express or implied, regarding the availability, reliability, or accuracy of the Service.

AI Disclaimer: The Service utilizes artificial intelligence and machine learning technologies. The Output generated by the Service is probabilistic and may be inaccurate, outdated, or offensive. You acknowledge that the Service does not provide professional legal, financial, or business advice. You should independently verify any Output before relying on it for business decisions.

10. Limitation of Liability

To the maximum extent permitted by law, Prakasya shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service.

Liability Cap: In no event shall our total liability to you for all claims arising out of or relating to these Terms or the Service exceed the amount you paid to us for access to the Service in the twelve (12) months preceding the claim. However, if the agreement between you and us constitutes a consumer contract under the Consumer Contract Act of Japan, this limitation of liability shall not apply to damages resulting from our intentional misconduct or gross negligence.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to conflict-of-law principles.

Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court in Japan.

12. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
